Thurnscoe woman brought to heel over dog noise complaint

A dog owner from Thurnscoe has been fined £1088 following a hearing at
Barnsley Magistrates Court on Thursday 28 March 2019. The prosecution
was served under the Environmental Protection Act 1990.

Lauren Jinks, 26, of Hanover Street, Thurnscoe, has been prosecuted
after she repeatedly failed to stop her pet from barking and disturbing
her neighbours.

Noise enforcement officers from Barnsley Council witnessed prolonged
periods of excessive and unreasonable barking at Ms Jinks’ address. The
dog barked continuously for hours when it was left alone, which was
audible in the neighbouring properties.

The council issued a noise abatement notice served under the
Environmental Protection Act 1990 on 25 October 2018 after measuring the
barking and being satisfied it amounted to a statutory nuisance.

Following breaches of this notice, the defendant was invited in for a
formal interview in December 2018. Ms Jinks said she would buy calming
medication for her dog, use calming sprays and investigate the use of
anti-barking collars to control the problem. Jinks also assured Barnsley
Council that if nothing else worked, she would not leave the dog alone
in the property. However, council officers witnessed further periods of
excessive barking, which resulted in a prosecution being raised against
the defendant.

The defendant pleaded guilty to the charges and was fined £200 for the
offence, £858 costs and a £30 victim surcharge, totalling £1088.

Julia Burrows, Director of Public Health at Barnsley Council, said: “Dog
owners need to be respectful of their neighbours and surroundings. Dogs
that are barking excessively and causing a nuisance to neighbours need
to be trained, and steps need to be put in place to improve the
situation.

“This prosecution should highlight the responsibility that dog owners
have and that we won’t hesitate to take legal action when it’s needed.”
